Refinance After Chapter 7 – A Shared Blog

One issue that comes up fairly often is how do you refinance a mortgage after bankruptcy when you have not reaffirmed the mortgage? This is a particularly big issue for my clients, because the local bankruptcy Judges will not allow a reaffirmation as it is of no benefit to the Debtor, only to the bank. As a result, I am sharing a blog post from Attorney James Spray in Colorado that I found interesting.  I will say that it is usually easier to refinance in MA, since the local lenders are starting to understand that not reaffirming is not a “choice” but a requirement. However, he has given this process a lot of thought and mentions some interesting things about how to get “credit” for these non-reaffirmed mortgage payments, so I am sharing this blog post.
